These Terms of Service ("Terms") govern your access to and use of the AirTipt mobile application and related services (collectively, the "Service") operated by TDOH INC. ("we", "us", "our"). Please read these Terms carefully before using AirTipt.
1. Acceptance of Terms
By downloading, installing, or using AirTipt, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree to these Terms, do not use the Service.
2. Description of Service
AirTipt is a peer-to-peer tipping application that uses Bluetooth Low Energy (BLE), Apple's MultipeerConnectivity framework, and Stripe to let users discover and send tips to people nearby. Payment processing and payouts are handled by Stripe, Inc. ("Stripe"). AirTipt is not a bank, money transmitter, or payment processor.
3. Eligibility
- You must be at least 13 years old to use AirTipt.
- You must be at least 18 years old to receive tips through AirTipt, because receiving tips requires a Stripe Express account, which Stripe restricts to adults.
- By using AirTipt, you represent that you meet these age requirements and that you are legally able to enter into these Terms in your jurisdiction.
4. User Accounts and Profiles
When you set up an AirTipt profile, you choose what to share with nearby users — for example, a display name, emoji, tagline, profession, and profile photo. You are responsible for the accuracy of the information you provide and for keeping your device secure. You may not impersonate another person or misrepresent your identity.
5. Payments and Fees
- Tips sent through AirTipt are real financial transactions processed by Stripe.
- Any platform fee or processing fee that applies to a tip will be displayed in the app before you confirm the transaction.
- Tips are non-refundable once sent, except where a refund is required by applicable law.
- You are responsible for ensuring you have sufficient funds and authorization to send the amount you choose.
6. Receiving Tips — Stripe Connect
- To receive tips, you must create a Stripe Express account through AirTipt and agree to Stripe's terms, including the Stripe Connected Account Agreement and Stripe Services Agreement.
- Stripe is solely responsible for verifying your identity, holding funds, and routing payouts. AirTipt does not hold user funds.
- You are responsible for reporting and paying any taxes that apply to tips you receive. AirTipt does not provide tax advice.
7. Notifications
AirTipt may send push notifications through the Apple Push Notification service (APNs), for example to alert you to an incoming tip. You can control or disable notifications at any time from the iOS Settings app.
8. Profile Visibility
When you enable Tipable mode, your profile becomes discoverable to nearby AirTipt users. The following information may be broadcast over Bluetooth and the local Wi-Fi network, and synced to our servers so other users can still see you while the app is backgrounded:
- Display name
- Emoji
- Tagline
- Profession
- Avatar URL (your profile photo on Cloudinary)
You can turn off Tipable mode at any time to stop being discoverable.
9. Prohibited Conduct
You agree not to use AirTipt to:
- Violate any applicable law or regulation.
- Scan, harvest, or otherwise collect information about other users for purposes outside of normal AirTipt use.
- Spoof, forge, or manipulate Bluetooth or local network signals to misrepresent identity or location.
- Harass, threaten, or harm other users.
- Engage in money laundering, fraud, sanctions evasion, or any other unlawful financial activity.
- Reverse-engineer, decompile, or attempt to extract the source code of AirTipt, except where this is expressly permitted by law.
- Interfere with or disrupt the Service or the servers and networks used to provide it.
10. Intellectual Property
AirTipt, the AirTipt name and logo, and all related content (other than user-supplied content such as your profile photo, name, and tagline) are owned by TDOH INC. and protected by intellectual property laws. We grant you a personal, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose. You retain ownership of content you submit, but you grant us a limited license to host and display that content as necessary to operate the Service.
11. Disclaimer of Warranties
The Service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, TDOH INC. disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components, or that any particular tip or payout will succeed.
12. Limitation of Liability
To the maximum extent permitted by law, TDOH INC. and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service. Our total cumulative liability for any claim arising out of or related to these Terms or the Service is limited to the total amount of fees you have paid to AirTipt in the twelve (12) months preceding the event giving rise to the claim.
13. Termination
You may stop using AirTipt at any time and may delete your account from the Profile screen inside the app. We may suspend or terminate your access to the Service if you violate these Terms or if we reasonably believe such action is necessary to protect AirTipt, our users, or third parties. Sections that by their nature should survive termination (including Sections 9–12 and 15) will survive.
14. Changes to These Terms
We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page. Significant changes may also be communicated through the AirTipt app. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
15. Governing Law
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles. You and TDOH INC. agree to submit to the exclusive jurisdiction of the state and federal courts located in the City and County of San Francisco, California, for the resolution of any dispute arising out of or related to these Terms or the Service.
